Terms & conditions

You must accept these terms and conditions in order to use Mituyu.

You'll find the more formal terms and conditions starting at the definitions section. We've arranged it this way to bring the code of conduct and privacy policy to the top of the document. However, this order does not imply meaning or import.

By using this website you accept these terms and conditions in full, and will have agreed to them in order to use the system, at which point your IP address was logged and time-stamped. If you are accepting these terms and using the services on behalf of a legal entity, you confirm that you are authorised to do so.

These terms and conditions were last updated on 4th March 2018.

Code of conduct

The other terms and conditions aside, you agree to adhere to a code of conduct in your use of Mituyu.

You may not use this system to store, publish or distribute any material that:

Mituyu do not undertake to monitor content published using the system. You do, however, grant us the right to remove any content deemed unsuitable, without seeking permission or entering into discussion.

We're based in the UK, so cookie disclaimers apply.

This website will write data into your browser's local cache in order to remember your identity. By using this site, you consent to receive this data.

Further to that, Mituyu relies on third parties that may serve you cookies:

In addition, Mituyu employs libraries from social networks, such as Twitter, Facebook, etc. From time to time, these services may also give your browser cookies.

When one of your audience clicks on a link you publish, Mituyu will give them a cookie with a timestamp. This doesn't contain any identifying or unique information to them, rather the identification of the link they clicked. This is for ROI-monitoring purposes. If you wish to give users an explanation of this, send them to https://mituyu.com/guide/cookies.

Our use of your data

In case you feel the need to see the letters G, D, P, and R here, that's what this section is all about; GDPR.

Your contact details: neither the software or the service provider will intentionally disclose your email address to any third party, with the exception that emails sent to you are delivered using the Postmark service.

Your password for the Mituyu system is one-way encrypted using a salted, 10,000-iteration PBK-SHA1 algorithm, to the extent that we can't read it either.

Where your visitors (also known as "complete strangers") interact with Mituyu (where they click links, view your web embed, etc), we only store aggregate data; that a click/view happened, and the rough time. We don't track identity, IP address, browser versions, etc.

Payments and refunds

Here we cover the fact that, irrespective of your exchange rate, our price is fixed in UK £ sterling, and that we don't refund licence fees you've already used.

All payments are taken in UK £ sterling. While this website displays currency conversion estimates on its front page, these are exactly that - estimates. The UK £ price is what you'll actually pay; your mileage may vary depending on the exchange rate between your bank account currency and the UK pound.

Mituyu's policy is, when deemed necessary, to refund only unused licence fees. In the event that a refund is issued, the associated licence will be shortened to expire at the point that the unrefunded period ends.

In which we assert what the service is, who we are, who you are, and what your content actually is in the context of these terms and conditions. No, you may not be frank, unless that actually is your name.

The service/the system/the software/Mituyu/mituyu.com/this website refers to the website and application accessible at https://mituyu.com.

The service provider/we/us refers to Zehuti Ltd.

You/the user refers to you, the user.

Your content describes any text, image, audio and/or video that you upload to Mituyu, as well as any links to such content elsewhere.

Use of this website

This is the part where you agree not to abuse the system.

Barring external libraries, the service provider owns the intellectual property rights for Mituyu, and the material provided within (excepting material created or uploaded by its users). Subject to other conditions stated within these terms, all intellectual property rights are reserved.

You may not use Mituyu in such a way that would cause damage or impairment to the service it provides, its availability or accessibility.

You will endeavour to keep your logon details confidential.

Rights to your content

Here, you agree that we have the right to distribute the content you upload, and that we won't accept legal liability for what you publish.

In uploading content, you grant us a worldwide, irrevocable, non-exclusing, royalty-free licence to use, reproduce, adapt, publish, translate and distribute your content in any existing or future media, and to transfer these rights by sub-license to other parties. You also accept that, by uploading content you make it freely-available for others to re-use and copy.

At no point does the service provider or guarantee the accuracy or truthfulness of any content published on Mituyu, and any opinions expressed by site users are not those of service provider. Mituyu accepts no responsibility for content published on its system.

User data retention

Here we tell you that, if we come across your email address but you don't engage with us, we'll throw it away after a month.

Mituyu follows a strict policy regarding retention of user data, and disposes of it on two criteria:

In which we all agree that Mituyu isn't liable for your actions, should you somehow find a way to injure yourself on a website, for instance, or decide that a five minute outage is the end of the frickin' world.

This service is provided "as is", without any representations or warranties, express or implied.

The service provider does not warrant or guarantee that this service will be constantly available, or in fact available at any point, and will not be liable to the user for:

This is the dense part, that you're probably going to briefly scan but not take a great deal of notice of, but it's important we put this stuff in here.

These terms and conditions constitute the entire agreement between you and Mituyu in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.

By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable. If you do not think they are reasonable, you must not use this website.

We reserve the right to preserve or disclose any private information you give us where necessary to comply with a law, legal process, or to protect the safety or security of any other person.

The service provider may transfer their rights and/or obligations under these terms and conditions to a third party without obtaining your consent or providing notification.

You, however, may not transfer your rights and/or obligations as laid out by these terms and conditions.

If you breach these terms and conditions in any way, the service provider may take such action as they deem fit, including suspending or cancelling your access to the service either directly or through your internet service provider. The service provider is not obligated to provide a refund in these eventualities. Further to this, the service provider may bring court proceedings against you.

Copyright of these terms and conditions

Look; we accept that most terms and conditions are either professionally-produced (and subsequently vast), or a web developer copies them from someone else's site and chops them about a bit. If nothing else, just think of this as a prize for bothering to scroll to this point:

The service provider grants unrestricted worldwide use, re-use, copying and editing of the text of these terms and conditions for use elsewhere.

By using, re-using, copying or editing these terms and conditions, you accept full and total responsibility for their efficacy, accuracy and use, and indemnify the service provider against any liability incurred by your use of them.

This service uses cookies to enable log-ons, enhance your user experience, and aid in content delivery. It also employs third-party services that may also issue cookies.
